CATERING CONTRACT:

 Tasting Fee’s:  Tasting fees are based on quantity of items and menu choices.  This fee is credited back when you book with Walla Walla Catering Co. on your final bill.

 Deposit:

Weddings and large caterings of 100 guests or more: a $100.00 deposit is required to hold your date.  Once menu and pricing has been selected then a 50% down payment is required.

 Final Payment:  Final payment is due one day before your event unless prior arrangements have been made.  Some billing may be required after your event.  Such as staffing, rentals, last minute items and or any damages.

 Cancellation Fees:  All prepayments, deposits and payments due are forfeited if you cancel the event at any time.  Walla Walla Catering Co. will apply the entire balance of your deposits and prepayments towards another event occurring within six months of prior date.  All costs are subject to change.

Wedding Receptions:

                        Cancellations received 60 -90 days prior to event will result in a 30% charge of the total bill.

                        Cancellations received 30-59 days prior to event will result in a 50% charge of the total bill.

                        Cancellations received 29 days or less prior to the event will result in a 100% charge of the total bill.

Late Bookings:  Your orders for service s must be received within one week prior to the date of service.  A minimum of two weeks planning is required for proper planning for your event.  Although we do understand certain circumstances arise and we are prepared to help with last minute bookings.  An 18% gratuity will be applied, and any additional express fees will apply.

Timeline:  You may be billed for additional staff hours if your event does not adhere to the agreed upon timeline.

 Guaranteed Attendance:  For groups up to 25: your final count for an event must be received 5 full working days prior to event date.  This count becomes your guaranteed number and is not subject to reduction.  For groups above 25: Your final head count for an event is 7 working days.  This count becomes your guaranteed number and is not subject to reduction.  You may increase your guest count; however some menu items may not be available to last minute additions or bookings.  Additional fees and charges may apply beyond the normal agreed upon expenses.  We, Walla Walla Catering Co. will do our best to accommodate your requests.  Some substitutions may need to be made.

Payments: Payment may be made in cash or checks payable to “Walla Walla Catering Co.”  Applicable state sales tax will be added.    We also accept all major credit card fees.  If any sum due to Walla Walla Catering Co. becomes delinquent, client agrees to pay interest upon the delinquency at the rate of 5% per annum, together with Walla Walla Catering Co. costs of collection and reasonable attorney’s fees.

 Service Charge:  a 15% service charge will be included on every event, unless otherwise indicated.  At the Client’s discretion, any additional tip/or gratuity will go directly to the service staff.

Wedding Receptions: an 18% gratuity will be included on your final billing.  At the clients discretion, any additional tip/or gratuity will go directly to the service staff

 Menu/Food Quantities:  Walla Walla Catering Co. will prepare between 5%-10% overage based on the final number of guests we receive from you.  Part of this overage is to include feeding of the staff, guests, with bigger appetites and or vendors.  You are not charged for this service.  If your guest count exceeds the number given, you will be charged for the additional guests on your final billing. 

 Leftovers:  Walla Walla Catering Co. (or you and your guests) may package up all leftovers that are not able to be reused.  You are responsible for providing appropriate containers to place leftovers into.  We have containers and will charge a fee for each container used.  If you choose not to have your leftovers boxed up we will donate them to the Christian Aid Center.  Walla Walla Catering Co. is not responsible for any food that is taken home and not stored properly.

Out of Town Events: For events in Walla Walla or College Place no delivery fee will apply.  The following fees apply for the surrounding areas.  These fees are subject to change.

Touchet, Lowden and Dixie $15.00 delivery fee

Tri-cities, Waitsburg, Dayton and Pendleton $25.00 delivery fee

Food & Beverages: All food will be supplied by our catering department.  Please consult with the Catering Advisor for any special needs.  Walla Walla Catering Co takes food allergy issues seriously and makes every effort to accommodate food allergy needs.  Please Note:  Walla Walla Catering Company’s foods are prepared in a facility that stores nuts, dairy, fish, shellfish, wheat and eggs.  Each piece of equipment is thoroughly cleaned and sterilized before and after each use.  Walla Walla Catering Company is not responsible for allergic reactions to foods provided.

 Alcohol: WW Catering Co. does not provide alcoholic beverages.  Client is responsible for all alcoholic beverages, service and following all Washington State Liquor Board Requirements.  It is your responsibility to obtain your own Liquor/Banquet Permit.  You may get your permit by going down to your local Liquor store.  We do however; have certified staff to serve your liquor/beer.  Our staff is charged out at $15.00 per hour with a minimum of 4 hours.

Staffing: Walla Walla Catering Co. charges $10.00 per staff with a minimum of 5 hours.  This time starts at the kitchen and until the event is finished.  I try to not go over 7 hours for each staff.  This charge is for loading the van, setting up for the event, staffing the event and clean up.  You are not charged for the preparation of the food or the clean up at our kitchen.

Catering Reservation:  You may call, 509.301.6251 for your reservation and or email us at wwcatering@msn.com  for your upcoming event. You may also fax your requests to 509.876.2524.  A contract will be sent once all details of your event are finalized.  Changes may be made up to two weeks prior to event.

Damage:  Walla Walla Catering Co. assumes no responsibility for any damage or loss of any merchandise, alcohol, equipment, furniture, clothing or other valuables prior to, during or after the event.  We will take reasonable steps to ensure that all of your supplies, rentals and equipment are cared for and maintained in good working order and without any damage.

The Client understands that by using/providing items that the Client owns or provides or by holding and event at Client’s home/office/club/property or other venue leased or arranged by Client (collectedly, the “event”) that accidents/breakage, damage and person injuries may occur (collectively, “losses”).  Walla Walla Catering Co. will have no liability for any losses, except to the extent that the losses result from the intentional misconduct or gross negligence of Walla Walla Catering Co. or its employees.

Indemnity:  The Client will indemnify, defend and hold harmless Walla Walla Catering Co. its employees, officers, directors and representatives from and against any and all liabilities, claims, damages, proceedings, judgments, fines and costs of every kind and nature, including but not limited to attorneys fees (collectively, “indemnified claims,  claims and expenses”), arising from the event, including, but not limited to all third party claims, except to the extent that the indemnified claims and expenses result from the intentional misconduct or gross negligence of Walla Walla Catering Co. or its employees.

Liability Limitation:  Walla Walla Catering Co. maximum liability to client arising from this contract, the breach hereof and the relationship of the parties is expressly limited to the fees due Walla Walla Catering Co. under this contract.  In no event will Walla Walla Catering Company be liable for Client’s lost profits, consequential damages, disruption damages or exemplary damages.

Third Party Liability: Walla Walla Cateirng Company assumes no responsibility for the conduct of your guests or invitees and for the conduct of third parties hired by you r or us to provide services.

Insurance:  Walla Walla Catering Co. maintains general liability and automobile liability insurance.  Walla Walla Catering Co. recommends that you obtain insurance to cover your liability arising from your event.

Assignment:  This contract is not assignable without the written consent of Walla Walla Catering CO, which consent may be withheld in Walla Walla Catering Co. absolute discretion.

Catering Contract:  Catering reservations are valid for up to one calendar year.  However, WW Catering Co. may adjust prices if your event is scheduled to occur more than 90 days after the reservation is accepted.  A signed copy of this contract must be on file in our offices in order for the contract to be valid.  This contract and the Catering Menu are the entire agreement between the parties concerning catering; and all amendments hereto and thereto and all waivers of rights hereunder and thereunder shall be in writing and signed by the parties.
